TERMS AND CONDITIONS
These terms and conditions are the basis of the contract between us. Please take time to read them carefully. You won't find anything out of the ordinary but you should understand the contract between us.
1. YOUR CONTRACT
Think Sitges is the trading style of Roger Charles Clement (NIE Y3968392D) who is licensed to carry out business in the Kingdom of Spain. All bookings accepted by Think Sitges from the person making the booking, on behalf of all persons included in the booking, are subject to the terms and conditions set out below. Any contract is made on these terms and conditions.
2. YOUR RESERVATION
We do not accept a reservation unless accompanied by a valid credit card number and the appropriate deposit has been charged successfully to the card. In providing your credit card number you authorise Think Sitges and/or the accommodation provider to charge the appropriate deposit and give your full authorisation for full payment to be charged to this card.
Once a deposit has been received then the contract between us is in force. We will allocate a unique booking reference number and email your confirmation/invoice to you straight away. If there is more than one person travelling then the person making the reservation is identified as the lead name and this person is responsible for all payments. We will not make any cancellation or amendments or enter into correspondence regarding the reservation with any other party other than the lead name.
YOUR LIABILITY
Think Sitges charges a security deposit on all its managed apartments. This deposit can be payable in cash on arrival or we can retain your credit card details and returned on departure after a satisfactory inspection of the apartment. A member of the Think Sitges team will check you into your apartment. During this check in we will confirm together the condition of the apartment. We will make an appointment to return at the end of your stay to check that the apartment is in the same condition and will return your deposit in full. If we discover that there has been any damage to the apartment during your stay the cost of repairs will be deducted from your deposit. If the damage exceeds the security deposit we will make arrangements with you to charge your card with the difference.
The amount of security deposits vary in our non-managed apartments where Think Sitges acts solely as a booking agent. These security deposits are collected, returned and managed in respect of any damage to their apartment by the apartment owner or agent, please see individual apartment entries for details.
Neither Think Sitges nor the accommodation provider or agent shall be liable for any direct or indirect damages that may arise as a consequence of the use of the apartment, including without limitation, damages, insurance, losses due to fires, robbery or criminal behaviour.
3. IF WE CHANGE YOUR BOOKING
It is extremely unlikely that any changes will be made to your reservation, but any that do occur are likely to be minor. A major change is defined as "a change to accommodation of a lower standard and price".
A major change is extremely rare but if we do make a change we shall do our best to notify you immediately. Under such circumstances it is our policy where possible to offer alternative accommodation. Once notified of a major change you will be given the opportunity either to cancel the holiday and receive a full refund but no compensation or to accept the change.
We are unable to make any refunds if changes are made as a result of force majeure which includes but is not limited to acts of God, acts or threat of war, government action, strike, civil unrest, fire, failure of public utilities, medical emergency, natural or nuclear disaster or airport closure.
4. CANCELLING YOUR BOOKING
Where Think Sitges is NOT the provider of the accommodation and/or acts as a Booking Agent we cannot accept responsibility for any changes in your accommodation by the property owners or managing agents.
5. IF YOU CHANGE YOUR BOOKING
Where Think Sitges is NOT the provider of the accommodation and/or acts as a Booking Agent we cannot accept responsibility for any changes in you make in your accommodation. Where Think Sitges is the managing agent, if you wish to change your booking, for example, change your departure date or your holiday accommodation, we shall try to help you. If we cannot help you we reserve the right to treat such changes as a cancellation of booking. If the number of guests on your reservation changes then we will recalculate your accommodation price by taking into account new occupancy levels. Should you depart your apartment early, for whatever reason, we are unable to offer a refund. We will provide information to your insurance company if you need it.
All changes must be notified to us in writing.
6. IF YOU CANCEL YOUR BOOKING
If you wish to cancel your booking this must be notified to us in writing and forwarded to us by the lead name, either by recorded and acknowledged mail or email. Cancellation charges will apply and these depend on when your written notification is received.
LESS THAN 90 DAYS’ NOTICE Cancellation charge of 40% of the total value of your booking.
LESS THAN 60 DAYS’ NOTICE Cancellation charge of 50% of the total value of your booking.
LESS THAN 30 DAYS’ NOTICE Cancellation charge of 100% of the total value of your booking.
Under some circumstances you may be able to recover some or all of the cancellation fees.
7. OUR LIABILITY
Think Sitges does not accept liability for death, injury or illness of anyone booked into or occupying the accommodation.
8. COMPLAINTS
Where Think Sitges is not the provider of your accommodation and/or acts as an information service provider and/or booking agent we cannot accept responsibility for any changes in your accommodation by the property owners, or managing agents. Where Think Sitges is the managing agent we have procedures designed to allow any difficulties to be resolved as efficiently as possible.
Please report any problem to our representative or agent, the accommodation supplier or the accommodation management. This means that any problems can be looked into straightaway and put right to the satisfaction of all concerned. In the unlikely event that the problem cannot be remedied you must contact us to advise us of the situation.
If you wish to make a complaint after your return home and only after the above procedures have been followed, you must do so in writing to our offices by recorded or registered mail to arrive no later than 28 days after the completion of your holiday.
9. WEBSITE AND BROCHURE ACCURACY
We work extremely hard to ensure that everything you read on our website is as accurate and up-to-date as possible. However, it is possible that certain advertised facilities may be withdrawn as a result of decisions outside our control such as local maintenance, conservation schemes, adverse weather or failure of public utilities. We do not accept liability if facilities are withdrawn for reasons beyond our control.
Occasionally we shall contact you with our latest offers and holiday information. If you do not want to be contacted, please advise our booking team or select the unsubscribe option which will remove you from further emails.
10. SPECIAL REQUESTS
We shall endeavour to satisfy any special requests you make, such as the provision of a travel cot or high chair. The fulfilment of special requests may be the subject of an additional charge.
11. BEHAVIOUR
Think Sitges reserves the right to terminate the contract between us at any point, in the light of any behaviour regarded as unacceptable and not within the spirit of this agreement. No refunds will be given and no alternative accommodation will be provided.
Please remember that the apartment you will be occupying is in a residential block. Neighbours may have to work so please respect their need for peace and quiet. You must accept responsibility for the proper conduct of you and your party. In cases of serious misconduct we reserve the right to terminate your holiday and if we do we shall have no further responsibility to you.
Accidents happen! If something untoward does happen to you during your stay in one of our apartments that results in damage or injury then inform us as soon as possible. If you damage your accommodation, you agree to indemnify us against any claim including costs made against us.
A spare key is held at the office. Replacement copies have to be paid for.
A normal amount of wear and tear is expected but beyond this we will levy a charge. Failure to report ANY damage or loss will result in a charge to your credit card.
12. INSURANCE
You should always be adequately insured before travelling overseas.
13. ADDITIONAL COSTS
We will not add any extra costs to your holiday after your booking has been confirmed unless you choose to purchase additional services such as airport pick up.
